Terms of Service

By accessing or using Delphos AI, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

These Terms apply to all users — Free, Pro, and Premium — and supersede any prior agreements relating to the Service.

You must meet the following age requirements to use Delphos AI:

• At least 13 years old in most countries.
• At least 16 years old if you reside in the European Union.
• Parental or guardian consent is required if you are below the applicable age threshold.

If you do not meet these requirements, you must discontinue use immediately. We may terminate accounts found to be in violation of this clause.

Delphos AI offers a suite of AI-powered tools and capabilities, including:

• Conversational AI with persistent memory and real-time web search
• FlayEngine™ multi-tool orchestration — search, code, PDF, image generation and more
• Browser Agent for headless browser automation — navigating sites, filling forms, retrieving data
• Google Connect integration (Gmail, Calendar, Tasks, Contacts) via secure OAuth
• Live Voice AI for real-time spoken conversation with tool execution
• Custom AI Characters and personalities
• AI Image generation and PDF export

You are solely responsible for how you use the Service. All usage must comply with applicable laws, regulations, and these Terms. We reserve the right to modify, limit, or discontinue any feature at any time.

When you enable Google Connect, you explicitly authorise Kognare to access specific Google API scopes on your behalf. These include Gmail (send only), Google Calendar, Google Tasks, Google Contacts, and your basic profile information.

Our use of Google API data is strictly limited to the features you activate and does not include advertising, data resale, or AI model training on your personal Google data.

As a user of Delphos AI, you agree to the following:

• You will not use the platform to generate harmful, illegal, abusive, fraudulent, or deceptive content.
• You will not attempt to reverse-engineer, scrape, exploit, or modify any part of the platform or its underlying models.
• You will not use Browser Agent or automation features to violate any third-party website's terms of service.
• You are fully responsible for all content you generate, upload, or transmit through the platform.
• You will keep your account credentials secure and not share them with others.
• You will not use the Service to spam, harass, or harm other individuals or services.

All content, trademarks, logos, source code, UI components, AI characters, and intellectual property associated with Delphos AI and Kognare are owned exclusively by Kognare.

• You may not use our brand name, logo, or product name without prior written permission.
• You may not reproduce, redistribute, or create derivative works from our platform or its components.
• AI-generated content produced through Delphos AI using your inputs is yours — you retain ownership of what you create.

We reserve the right to suspend or permanently terminate your account at our discretion if you:

• Violate any provision of these Terms of Service
• Engage in fraudulent, abusive, or illegal activity on the platform
• Attempt to circumvent platform limits, abuse quotas, or exploit the service
• Cause harm to other users, third parties, or Kognare's infrastructure

You may also delete your account at any time from your account settings. Upon deletion, you may request full data removal by contacting [email protected].

Delphos AI is provided "as-is" without warranties of any kind, express or implied. Specifically:

• AI outputs may occasionally be incorrect, incomplete, or biased. Always apply your own judgment before acting on AI-generated information.
• Browser Agent and automation features may not work perfectly on all websites, as third-party sites may change their structure or block automated access.
• We do not guarantee 100% uptime, availability, or uninterrupted service. Scheduled and unscheduled maintenance may occur.
• We are not liable for damages, losses, or decisions made based on reliance on AI outputs.

To the maximum extent permitted by applicable law, Kognare shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or business interruption — arising from your use of, or inability to use, the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to Kognare in the twelve (12) months preceding the claim, or ₹1,000 — whichever is greater.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or your use of Delphos AI shall be subject to the exclusive jurisdiction of the courts located in India. By using the Service, you consent to this jurisdiction.

We are committed to complying with applicable data protection and privacy laws across jurisdictions:

• GDPR (EU): We honour rights to data access, correction, deletion, portability, and objection. EU users may contact us to exercise these rights.
• CCPA (California, USA): California residents may opt out of data sharing or request deletion of personal information.
• COPPA (USA): We do not knowingly collect personal information from children under 13.
• PDPB (India): We comply with India's applicable data protection obligations as they come into effect.

We may update these Terms of Service from time to time. When we make material changes, we will:

• Display a notice on the Delphos platform prior to the changes taking effect.
• Update the "Last Updated" date at the top of this page.
• Notify you by email for significant changes if you have an account with us.

Your continued use of Delphos AI after any modification constitutes your acceptance of the updated Terms.
